Pollo API Terms and Conditions

01. Introduction
Welcome to Pollo API, a unified AI video & image models API platform. By accessing or using our API platform, developer platform, SDKs, or associated documentation (collectively, the "API Service"), you agree to be bound by these Terms of Service (the "Terms"). These Terms govern your use of the API Service provided by Pollo API ("we," "us," or "our").
Please read these Terms carefully before using the Service. If you do not agree with any part of these Terms, you must not use the Site or the Service.

02. Eligibility
To use the API Service, you must be at least 18 years old or have reached the age of majority in your jurisdiction. If you are accessing the API Service on behalf of a company or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
03. Account Registration and API Key Security
To access the API Service, you must register for a developer account and provide accurate, complete, and up-to-date information.
- You are solely responsible for maintaining the confidentiality of your account credentials and API Keys.
- You must never expose your API Keys in client-side code, public repositories, or any environment where unauthorized parties may access them.
- You must notify us immediately at [email protected] if you suspect any unauthorized use of your API Keys or account.
04. Use of the API Service
4.1 Permitted Use
Pollo API grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the API Service solely to develop, test, and operate your own applications or products.
You may allow your end-user customers to access Pollo's AI features through your integrated interface, provided you do not expose our APIs directly to end users.
4.2 Prohibited Conduct
You agree not to:
- Use the API Service for any illegal purpose or in violation of applicable laws.
- Reverse engineer, decompile, or attempt to extract the source code, weights, or algorithms of any Pollo AI model.
- Use the API Service, inputs, or generated outputs to develop or improve any competing AI model or product.
- Resell, redistribute, or white-label the API Service as a standalone developer product without our explicit written authorization.
- Exceed rate limits, bypass usage restrictions, or attempt to gain unauthorized access to our systems.
- Introduce malicious code, viruses, or harmful content into the API Service.
- Use automated scrapers or bots to extract data, documentation, or models from our platform.
- Share API Keys publicly or use them in a way that allows unauthorized third-party access.
05. Content Restrictions
The content restrictions that apply to the Pollo API platform apply equally to the API Service. You are responsible for ensuring that all inputs submitted and outputs generated through your integration comply with our content policies.
You must not generate or facilitate the creation of:
- Illegal, harmful, abusive, defamatory, or otherwise objectionable content.
- Explicit or adult content, including depictions of sexual abuse or exploitation.
- Deepfakes, unauthorized biometric impersonations, or content intended to deceive or defraud.
- Content that infringes upon the intellectual property or privacy rights of any third party.
- AI-generated content that is misleadingly presented as factual, human-made, or endorsed by a real person.
- Any content involving minors in sexual, exploitative, or dangerous contexts.
If you make the API Service available to end users through your application, you must bind those users to terms of service that incorporate these content restrictions.
06. Customer Data and Inputs
You retain ownership of any content you submit to the API Service ("Customer Input") and any content generated in response ("Output Content").
By using the API Service, you grant Pollo API a limited license to process your Customer Input solely for the purpose of providing the API Service.
We do not use Customer Input or Output Content processed through the API to train our AI models unless you explicitly authorize us to do so.
07. Intellectual Property
All intellectual property rights in the API Service, including our AI models, platform infrastructure, documentation, and trademarks, are owned by Pollo API or its licensors. You are granted no rights in these materials except as expressly stated in these Terms.
You may not copy, modify, distribute, or create derivative works based on our API platform without explicit permission.
Any feedback, suggestions, or ideas you provide regarding the API Service will be the exclusive property of Pollo API, and we may use such feedback without any obligation or compensation to you.
08. Suspension and Termination
8.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to access and use the API Service will immediately cease.
8.2 Termination by Pollo API
Pollo API may suspend or terminate your account and API access, with or without notice, for any reason, including but not limited to your violation of these Terms, fraudulent activity, or abuse of the API Service.
8.3 Effect of Termination
Upon termination, all licenses granted to you under these Terms will immediately terminate, and you must cease all use of the API Service. Any accrued rights or obligations will survive termination, including those related to intellectual property and indemnification.
09. Disclaimers and Limitation of Liability
9.1 Disclaimer of Warranties
The API Service is provided on an "as is" and "as available" basis without any warranties of any kind. Pollo API does not warrant that the API Service will be uninterrupted or error-free, or that generated outputs will be accurate, original, or suitable for any particular purpose.
Due to the nature of generative AI, outputs may contain errors or inaccuracies. You are solely responsible for reviewing and validating all outputs before use.
9.2 Limitation of Liability
To the maximum extent permitted by law, Pollo API will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the API Service, whether based on warranty, contract, tort, or any other legal theory, even if Pollo API has been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pollo API and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the API Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
11. Miscellaneous
11.1 Entire Agreement
These Terms constitute the entire agreement between you and Pollo API regarding your use of the API Service and supersede any prior agreements between you and Pollo API.
11.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
11.3 Waiver
The failure of Pollo API to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
11.4 Assignment
You may not assign or transfer these Terms or any of your rights or obligations under these Terms without the prior written consent of Pollo API. Pollo API may freely assign these Terms without restriction.
